Short sales are notoriously risky, unreliable and frustrating primarily because of
how the banks are processing them; at a snails pace and often void of logic and reason. As Realtors in the Portland market we’ve seen more than our share of short sale transactions and we’ve seen a number of them go to foreclosure, list and sell for a price very close to a short sale offer that was on the property before it foreclosed, occasionally for more than the REO list price. This is doing a dis-service to everyone involved including the bank itself as it’s not cheap to foreclose on a home. The National Association of Realtors yesterday aired some grievances about the foreclosure, loan modification and short sale processes and have apparently been meeting with some of the largest banks to discuss these issues, like Bank of America, Wells Fargo and they have meetings scheduled with JP Morgan Chase and Citi. The link below shows the 4 foreclosures that listed today (yes, only 4 to the usual 30), but in that small list is a jewel of a find, a Ryan Olsen home! Listed at about $390k…. take a look! It’s in bumpable status which means there is another offer but that other offer is contingent on their home selling so this lovely is still up for grabs! -Kristie McD.

Interesting list today. Remember I post the REO properties almost daily on my Twitter account. Anyhow, we have a home in Persimmon here (very nice neighborhood in Gresham), a few homes (although overpriced) in Happy Valley, and of course our HUGE variety of broken down homes under $200k. There are certainly plenty of first time home buyers to pick those up out there right now! However the inner Portland Bungalow that everyone REALLY wants is in limited supply.

That’s alot of Bank owned listings today, especiall for a weekend… however, as usual, the majority of them are under $250,00 and the majority of those under $200,000. Not too many higher end homes, if you are looking for something in West Linn there is a great one towards the end of the report. With short sales the seller is already risking getting a 1099 for the difference of what they owed
on the home and what it sold for after their “bank” approved the sale, this is known as phantom income. As such it’s standard practice for Realtors talking to a seller about selling short to advise them to speak to a CPA and/or real estate / tax attorney about the tax consequences before doing it…Well, it’s getting even more complicated now, apparently there’s a new trend of lenders beginning to require sellers to sign a note to repay that difference or they will not allow the sale; this is on top of the 1099.

I couldn’t let such an article go by without at least some comment. Firstly, if the reporter wanted to find a story about seller loss and despair they could have found a better storyto tell. And Francesca that they used as their example was a poor one. There are many streets of McMansions but Francesca isn’t one of them. The homes are smaller and simple in comparison to those just down the road in Bella Casa and from what I understand, that is where the reporter had originally decided to base his story….. a few months ago when he wondered the neighborhood looking for a story to tell. Funny too that the picture used in the Oregonion article neglected to show the power lines that loom just over many the homes making several of them much less desireable. (more…)
